Lewis & Roberts does not assist individuals or corporations seeking to declare bankruptcy. However, it is sometimes the case that an individual or corporate bankruptcy is a result of someone else's negligence or fraud. When this occurs, the bankrupt debtor's "estate" may have a claim against a negligent or fraudulent "third party." A bankruptcy court, or a bankruptcy trustee, may conclude that litigation should be asserted by the estate against third parties to recover damages for or assets that should belong to the estate. In such a situation, the bankruptcy court may appoint "special counsel" to assist the trustee in bringing claims on behalf of the bankrupt debtor's estate.
