Tragic Accident Leads to Insurance Coverage Dispute

When a construction worker was critically injured and permanently disabled in an automobile accident, Lewis & Roberts defended the general contractor and its insurance carrier. Lewis & Roberts successfully argued that the construction company’s insurance carrier – not the general contractor’s carrier – should have primary responsibility for the plaintiff’s disability payments. The NC Industrial Commission agreed and overturned a prior ruling that found both carriers equally liable. The ruling was confirmed by the NC Court of Appeals and the Supreme Court.
