Call Center Operators Win Court Approval and Settlement.

On August 27, 2015, the Federal Court for the Middle District of North Carolina approved a class and collective action settlement for customer service telephone operators in the Citicorp Credit Services call center located in Greensboro, North Carolina. Jim Roberts has been appointed lead counsel for the call center operators.

Off-The-Clock Work Claimed by Operators

The Citicorp call center operators claimed that Citi required each employee to perform certain administrative tasks before they logged into their telephones to begin receiving incoming calls. Each employee's pay began only after they logged into the phone system. The call center operators alleged that the work they did off-the-clock was work for which they were not paid - in violation of the Federal Fair Labor Standards Act - the FLSA. Similar legal claims were also asserted under North Carolina law. The Court preliminarily granted approval of the class and a settlement on behalf of the customer service operators. A final approval hearing occurred on November 30, 2015. The settlement was approved and funds were disbursed to hundreds of Citi's call center workers in January 2016.
