Medical Malpractice is legally defined as a breach in the "standard of care" expected in the "same or similar community" from a medical practitioner "with similar education, training and experience." The legal definition of Medical Malpractice requires attorneys to obtain as much information as possible on the medical treatment provided by physicians, physician extenders, nurses and hospitals or nursing homes in order to determine whether or not Medical Malpractice has occurred.

Generally, the medical care that has caused the injury or death of an individual must be reviewed by another physician, nurse or hospital administrator to prove that medical negligence occurred. Once all of the relevant medical records have been obtained, we will provide copies to other physicians who have agreed to review the medical care and provide an opinion whether or not there has been a breach in the standard of care.
