Construction Defects

  • Representing hundreds of homeowners in North Carolina, South Carolina, Virginia, New York, Pennsylvania, Illinois, Texas and Mississippi against builders, subcontractors and manufacturers arising from water intrusion and resulting damages caused by synthetic stucco (EIFS).
  • Representing several homeowners in a development in Iredell County against a national “production” builder for construction defects and shoddy workmanship.
  • Representing homeowners in a class action against Finestone, a manufacturer of synthetic stucco (EIFS).

Toxic Mold

  • Representing several owners in federal court lawsuit involving mold contaminated luxury apartments in Washington, DC. Clients have sustained severe personal injuries and property loss due to the mold contamination.
  • Representing physician in Greensboro, North Carolina in bad faith insurance claim lawsuit stemming from failure of insurance company to properly investigate plumbing leak. Client and son have sustained severe personal injuries due to the resulting mold contamination.
  • Representing several current and former tenants in mold contaminated retirement facility in Orange Park, Florida. Class action certification has been requested. Clients have sustained severe personal injury and property loss due to the mold contamination.
  • Representing owners of mold contaminated townhouse in Raleigh, North Carolina in Superior Court lawsuit. National builder knowingly constructed firewalls with visible mold over project manager's objections. Clients have sustained severe personal injury and property loss due to the mold contamination. Builder has moved to compel arbitration. Recently settled claims of 20 other owners in the town home community.
  • Representing owner in Virginia Beach, Virginia in bad faith insurance claim lawsuit stemming from failure of insurance company to properly remediate leak in house. Client has sustained total loss of extensive business inventories at home/office.
  • Representing church in Orange City, Florida in lawsuit against Builder of several additions (dormitory, gymnasium, and parking lot) at Church Bible College. Severe water intrusion has caused wide spread mold contamination leading to evacuation of 100 student dormitory. In addition to extensive property damage, students have sustained personal injuries.
  • Representing several tenants in the Jacksonville, Florida area in lawsuit against landlord/owner of mold contaminated apartment building. Clients have sustained severe personal injury and property loss due to the mold contamination.
  • Representing numerous parents and children in four lawsuits against the Board of Education in Topsail Beach, North Carolina involving four mold contaminated schools. Class action certification has been requested. Clients have sustained severe personal injury due to the mold contamination. Shortly after filing of the lawsuits, the Board of Education closed the High School and conducted an extensive remediation.
  • Representing family in Maple Glen, Pennsylvania in lawsuit against contractor and material suppliers involved in faulty construction of timber framed home. Severe water intrusion has led to extensive mold contamination. Clients have sustained severe personal injury and property loss due to the mold contamination.

Medical & Professional Malpractice

  • Representing a patient in Mecklenburg County who suffered deep second degree burns during a routine surgical procedure using an electrosurgical instrument.
  • Representing investors in cases against a national bank and accounting firm for deceptive and failed investment tax strategy.
  • Representing member of limited liability company deprived of interest in company by being forced out by two majority members.

Nursing Home Abuse & Neglect

  • Representing a patient whose right leg was amputated above the knee after nursing home failed to treat poor circulation for approximately four months.
  • Representing the family of a mother who died after an above the knee amputation was necessitated by the nursing home's failure to treat bed sores.
  • Representing family of resident of assisted living facility who was denied transport to the local emergency room by the facility's director on at least four separate occasions in one day.  The resident pulled her emergency call bell several times yet transport was continually denied.  The resident subsequently died.  The county Division of Social Services later determined that medical treatment was withheld by the facility.

Personal Injury

  • Representing steel worker who suffered spinal injury and is now living with paraplegia after three steel beams weighing in excess of one ton fell off a trailer and caused a crushing injury to his back.  The defendant trucking company failed to place safety stakes on the side of the trailer from which the steel fell.
  • Representing family of deceased man who was killed in Greene County as the result of a fuel tank fire after a motor vehicle collision.
  • Representing homeowners in Carteret County exposed to carcinogens in well water as the result of leaking gasoline storage tanks at a service station.
  • Providing pro bono representation to the father of a firefighter killed at the World Trade Center on 9/11.
